ONB is the "controller" under data protection law with regard to the processing activities of personal data described below. The following privacy policy provides an overview of which personal data of applicants for a position at ONB is collected and processed, for what purposes and on what legal basis. We also inform you about the (possible) recipients of your data and your rights under data protection law, known as data subject rights.
The following data in particular will be collected from you as part of the application process: Title, first name, surname, date of birth, nationality, residential address, telephone number, email address, notice period, source of application, education, professional experience, salary expectations and any data and images contained in the application letter, CV, references or other documents submitted or transmitted. This data is recorded and processed electronically by ONB in the applicant database for the selection process in order to fill vacant positions. Your data is recorded and processed exclusively for the purpose of storing, evaluating, assigning and transmitting your application. We do this on the legal basis of our overriding legitimate interest in conducting an efficient application process (Art. 6(1)(f) GDPR) and on the basis of the necessity to carry out pre-contractual measures (Art. 6(1)(b) GDPR). We collect this data as part of the application process either by you providing it to us (e.g. by submitting it via the online form) or by us collecting it ourselves (e.g. during the interview).
Your data will be treated confidentially. It is accessible to ONB’s human resources department and will only be made available to selected managers and employees of ONB for the purpose of conducting the selection process. The data will only be passed on to third parties in the following cases:

Your data will be stored for a period of seven (7) months after notification of rejection in order to be able to defend ourselves against any claims asserted under the Equal Treatment Act. If no claims are asserted within this period, your data will be deleted, as after this period the assertion of claims under the Equal Treatment Act can be ruled out.
In the event of claims being asserted within the specified period under the Equal Treatment Act, the data will be stored until the proceedings have been concluded with final legal effect.
In the event of a new application, the 7-month period will start again after a new rejection. After these 7 months have expired, you will receive an automatically generated email informing you that your data will be deleted.
Your data collected in connection with the application will be retained for the duration of the statutory retention period or for as long as any mutual legal claims are not yet time-barred.
1. Right to information: You have the right to obtain information from ONB about the personal data it processes about you, as well as about: (a) the purposes of the processing; (b) the categories of personal data that are processed; (c) the recipients or categories of recipients to whom the personal data have been or will be disclosed; (d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period; (e) the existence of the right to request from ONB the rectification or erasure of personal data concerning you or the restriction of processing; or the right to object to such processing; (f) the existence of a right to lodge a complaint with a supervisory authority; (g) if the personal data is not collected from you, all available information about the origin of the data; (h) the (non-) existence of automated decision-making, including profiling. In this case, ONB will provide a copy of the personal data that is the subject of the processing. For any further copies you request, ONB may, under certain circumstances, charge a reasonable fee based on administrative overheads. If you submit your request electronically, ONB shall provide the information in a commonly used electronic format, unless you specify otherwise.
2. Right to rectification and erasure: You have the right to request that ONB rectify any inaccurate personal data concerning you without delay. Taking into account the purposes of the processing, you have the right to request the completion of incomplete personal data, including by means of a supplementary statement. Furthermore, you have the right to request that ONB delete personal data concerning you without delay, and ONB is obliged to delete personal data without delay if one of the following reasons applies: (a) The personal data is no longer necessary for the purposes for which it was collected or otherwise processed. (b) You withdraw your consent on which the processing is based and there is no other legal basis for the processing. (d) The personal data has been processed unlawfully. (e) Deletion of the personal data is necessary to fulfil a legal obligation to which ONB is subject.
In particular, the right to erasure does not apply if the processing is necessary for ONB to comply with a legal obligation and/or to assert, exercise or defend legal claims.
3. Right to restriction of processing: You have the right to request that ONB restrict processing if one of the following conditions is met: (a) the accuracy of the personal data is/was contested by you, for a period enabling ONB to verify the accuracy of the personal data, (b) the processing is unlawful and you have refused to have the personal data erased and have requested the restriction of the use of the personal data instead; or (c) ONB no longer needs the personal data for the purposes of processing, but you need it for the assertion, exercise or defence of legal claims, or (d) you object to the processing, whereby the restriction shall apply until it has been determined whether the legitimate reasons of ONB outweigh yours.
If processing has been restricted, this personal data may — apart from its retention — only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or a Member State. If you have obtained a restriction on processing, ONB will inform you before the restriction is lifted.
4. Right to data portability: If processing is based on consent and carried out using automated means, you have the right to receive the personal data concerning you that you have provided to ONB in a structured, commonly used and machine-readable format. When exercising your right to data portability, you have the right to have the personal data transmitted directly from ONB to another controller, where technically feasible.
5. Right to lodge a complaint with a supervisory authority: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the legal requirements.
